Up until recently, when buying a home there was only one way of working with a real estate sales associate–Seller’s Agency, where all agents were working on behalf of the sellers. That meant that an agent could show you homes on behalf of their respective sellers and could not represent a Buyer’s interests. So, as a buyer, any negotiation over price and terms was entirely your responsibility. Thankfully, times have changed and now, Buyer Agency enables an agent to work solely on your behalf. As a result, Buyer Agency is employed in virtually all of today’s home purchases.

You have a choice. Buyer’s Agency is not mandatory. You may continue to be shown houses by a Sales Associate who is representing the seller and negotiate on your own behalf although there is no advantage for a buyer to do so. Your agent, however, is required to make you aware of your options at your very first substantial discussion.
